Top CIA Officer in Benghazi Delayed Response to Terrorist Attack
A U.S. security team in Benghazi was held back from immediately responding to the attack on the American diplomatic mission on orders of the top CIA officer there, three of those involved told Fox News’ Bret Baier.
Their account gives a dramatic new turn to what the Obama administration and its allies would like to dismiss as an “old story” – the September 11, 2012 Benghazi attacks that killed U.S. Ambassador Christopher Stevens and three other Americans.
Speaking out publicly for the first time, the three were security operators at the secret CIA annex in Benghazi – in effect, the first-responders to any attack on the diplomatic compound. Their first-hand account will be told in a Fox News special, airing Friday night at 10 p.m. (EDT).
Based on the new book “13 Hours: The Inside Account of What Really Happened in Benghazi” by Mitchell Zuckoff with the Annex Security Team, the special sets aside the political spin that has freighted the Benghazi issue for the last two years, presenting a vivid, compelling narrative of events from the perspective of the men who wore the “boots on the ground.”
The security contractors — Kris (“Tanto”) Paronto, Mark (“Oz”) Geist, and John (“Tig”) Tiegen — spoke exclusively, and at length, to Fox News about what they saw and did that night. Baier, Fox News’ Chief Political Anchor, asked them about one of the most controversial questions arising from the events in Benghazi: Was help delayed?
Word of the attack on the diplomatic compound reached the CIA annex just after 9:30 p.m. Within five minutes, the security team at the annex was geared up for battle, and ready to move to the compound, a mile away.
“Five minutes, we’re ready,” said Paronto, a former Army Ranger. “It was thumbs up, thumbs up, we’re ready to go.”
But the team was held back. According to the security operators, they were delayed from responding to the attack by the top CIA officer in Benghazi, whom they refer to only as “Bob.”
“It had probably been 15 minutes I think, and … I just said, ‘Hey, you know, we gotta– we need to get over there, we’re losing the initiative,’” said Tiegen. “And Bob just looks straight at me and said, ‘Stand down, you need to wait.’”
“We’re starting to get calls from the State Department guys saying, ‘Hey, we’re taking fire, we need you guys here, we need help,’” said Paronto.
After a delay of nearly 30 minutes, the security team headed to the besieged consulate without orders. They asked their CIA superiors to call for armed air support, which never came.
Now, looking back, the security team said they believed that if they had not been delayed for nearly half an hour, or if the air support had come, things might have turned out differently.
“Ambassador Stevens and Sean [Smith], yeah, they would still be alive, my gut is yes,” Paronto said. Tiegen concurred.
“I strongly believe if we’d left immediately, they’d still be alive today,” he added.
In a statement to Fox News, a senior intelligence official insisted that, “There were no orders to anybody to stand down in providing support.”
Baier put that assertion directly to the operators.
“You use the words ‘stand down,’” Baier noted. “A number of people now, including the House Intelligence Committee insist no one was hindered from responding to the situation at the compound…so what do you say to that?”
“No, it happened,” said Tiegen.
“It happened on the ground– all I can talk about is what happened on that ground that night,” added Paronto. “To us. To myself, twice, and to– to Tig, once. It happened that night. We were told to wait, stand– and stand down. We were delayed three times.”
In a statement to Fox News, a senior intelligence official did allow that the security team was delayed from responding while the CIA’s top officer in Benghazi tried to rally local support.
In the special, Baier also asks about the infamous YouTube video that was blamed for the violence in Benghazi.
Paronto laughed at the suggestion that the video played any role in the events of that night, saying he did not even know of the video until he was out of Libya and on his way home. “I didn’t know about the video ‘till I got to Germany,” he said. “(I had) no idea about any video, no. No, sir.”

Joan Rivers Dies at 81
Joan Rivers — who made the world laugh for over 50 years with her jokes, put-downs and one-liners — has died in NYC … a week after her heart suddenly stopped beating during vocal cord surgery.
She was 81.
Joan’s daughter Melissa Rivers took her mom off life support so she could pass comfortably in a private room.
The death has been reported to the NYC Medical Examiner’s Office — and officials tell TMZ the office will open an investigation to determine cause of death.
Melissa just issued a statement saying, “It is with great sadness that I announce the death of my mother, Joan Rivers.”
“She passed peacefully at 1:17 PM surrounded by family and close friends. My son and I would like to thank the doctors, nurses and staff of Mount Sinai hospital for the amazing care they provided for my mother.”
“Cooper and I have found ourselves humbled by the outpouring of love, support and prayers we have received from around the world.They have been heard and appreciated.”
“My mother’s greatest joy in life was to make people laugh. Although that is difficult to do right now, I know her final wish would be that we return to laughing soon.”
Rivers is widely credited for opening doors for countless female comediennes. She broke through in a big way during her appearances on “The Tonight Show” with Johnny Carson.
She also famously enraged Carson by accepting a gig to host a competing late night show on FOX. Carson never spoke to her again.
Second Journalist Beheaded by Muslim Terrorists
DEVELOPING: An Internet video purports to show the beheading of US reporter Steven Sotloff by the Islamic State extremist group.
The global terror intelligence firm SITE first reported the release of the 2-minute video, titled “A Second Message to America,” in which Sotloff, a 31-year-old freelance journalist, speaks to the camera before a cloaked Islamic State fighter decapitates him.
“I’m sure you know exactly who I am by now and why I am appearing,” Sotloff said under apparent duress. “Obama, your foreign policy of intervention in Iraq was supposed to be for preservation of American lives and interests, so why is it that I am paying the price of your interference with my life?”
The video then cuts to the masked militant warning that as long as U.S. missiles “continue to strike our people, our knife will continue to strike the necks of your people.” He also threatens the life of British captive David Cawthorne Haines.
“I’m back Obama,” said the left-handed executioner with a British accent who appears to be the same man who killed Foley. “And I’m back because of your arrogant foreign policy towards the Islamic State.”
The grim video comes just days after Sotloff’s mother, Shirley, directly addressed the leader of the Islamic State last week, saying her son shouldn’t pay for U.S. government actions in the Middle East and that he cared about the weak and oppressed as a journalist.
“I want what every mother wants, to live to see her children’s children,” she said last week. “I plead with you to grant me this.”
Shirley Sotloff cited by name the leader of the Islamic State, Abu Bakr al-Baghdadi, who has described himself as a caliph intending to lead the Muslim world. She had asked him to show mercy and follow the example of the prophet Muhammad in protecting people of Muslim, Jewish and Christian faiths.
Sotloff was last seen in August 2013 in Syria. He was recently threatened with death by the militants on a video unless the U.S. stopped airstrikes on the group in Iraq. The same video showed the beheading of fellow American journalist James Foley, 45.
Several U.S. officials, including U.S. Rep. Ileana Ros-Lehtinen, R-Fla., have said they were working behind the scenes to find out more about Sotloff and try to secure his release.
White House Press Secretary Josh Earnest could not confirm the reports when asked about the video at Tuesday’s press briefing. He noted the administration has been monitoring his situation carefully since threats were first made.
“The United States, as you know, has dedicated significant time and resources to try and rescue Mr. Sotloff,” he said, adding “thoughts and prayers” are with the family.
State Department spokeswoman Jen Psaki said the intelligence community will work “as quickly as possible” to determine the video’s authenticity.
“If the video is genuine, we are sickened by this brutal act taking the life of another innocent American citizen,” she told reporters.
Pressed by Fox News, Psaki would not say whether this would constitute an act of war. She said the prior execution of journalist James Foley was a “horrific terrorist act,” and was a “motivating” factor for creating a coalition to address the Islamic State.
A spokeswoman for the National Security Council confirmed that the agency had seen the purported video.
“The intelligence community is working as quickly as possible to determine its authenticity,” spokeswoman Bernadette Meehan said in a statement. “If genuine, we are appalled by the brutal murder of an innocent American journalist and we express our deepest condolences to his family and friends. We will provide more information when it is available.”
A family spokesman told The Associated Press that Sotloff’s relatives were aware of the video and are grieving his death.

PC FBI Report on Terrorism Omits Any Mention of Islamic Threat
The FBI’s most recent national threat assessment for domestic terrorism makes no reference to Islamist terror threats, despite last year’s Boston Marathon bombing and the 2009 Fort Hood shooting—both carried out by radical Muslim Americans.
Instead, the internal FBI intelligence report concluded in its 2013 assessment published this month that the threat to U.S. internal security from extremists is limited to attacks and activities by eight types of domestic extremist movements—none motivated by radical Islam.

They include anti-government militia groups and white supremacy extremists, along with “sovereign citizen” nationalists, and anarchists. Other domestic threat groups outlined by the FBI assessment include violent animal rights and environmentalist extremists, black separatists, anti- and pro-abortion activists, and Puerto Rican nationalists.
“Domestic extremist violence continues to be unpredictable and, at times, severe,” the report states.
A copy of the unclassified, 60-page National Threat Assessment for Domestic Extremism, dated Aug. 14, was obtained by the Washington Free Beacon. It warns that the threat of domestic-origin extremism was moderate in 2013 and will remain so for this year.
“Domestic extremists collectively presented a medium-level threat to the United States in 2013; the FBI assesses the 2014 threat will remain close to this level,” the report said.
On black separatists, the report warned that a “high-profile racially charged crimes or events” could lead to an expansion of black separatist groups. The report identified three such groups as the New Black Panther Party, the Israelite Church of God in Jesus Christ, and the Black Hebrew Israelite group as extremists under FBI scrutiny.

Bernie Goldberg: Life and Death in Polarized America
Sooner or later everything becomes polarized in this divided country of ours. It’s against the rules to see the other side’s point of view. That’s like giving ammo to the enemy. Besides, in media circles, where people make a good living dividing Americans, seeing the other guy’s point of view is bad for business.
When he first ran for president Barack Obama promised to unify us. You remember what he said about no Red America or Blue America, just a United States of America.
Instead we got the most polarizing president since Lincoln. I don’t know anybody who’s lukewarm on Mr. Obama. Liberals adore him – or at least have adored him for most of his presidency. And conservatives don’t simply disagree with him; many detest him. If he were caught on video robbing a bank, liberals would find an excuse to exonerate him. “He was just withdrawing money he had deposited, but the bank was closed. What was he supposed to do?” And if he found a cure for cancer, conservatives would condemn him for not finding it sooner. “If he didn’t play so much golf, he’d have found a cure years ago which would have saved the lives of many little children.”
Which brings us to Ferguson, Missouri. Nobody knows what actually happened there, except for the police officer involved – and we haven’t heard from him. Was he justified in shooting an unarmed kid 6 times or did he panic and overreact to some imaginary threat? We don’t know.
But in a polarized America, everybody is an expert. And everybody must take sides. To sit on the sidelines and wait for the facts to come in is a sign of weakness. Warriors don’t sit on the sideline — ever.
So if you’re a liberal who gets what passes for news from MSNBC you know what happened: The racist white cop shot the black kid because he’s a racist white cop.
And if you’re a conservative who gets the lowdown from Fox, you’re pretty sure the cop is getting railroaded. Didn’t Michael Brown bust the cop in the face and fracture his eye socket? That’s what Fox News reported, initially getting its information from a conservative website. The report may be true – or not. But so far no one in authority has confirmed the story. But if you play right field, you’re hoping the story is true because that would confirm what you always knew – that the cop was right and the kid was wrong.
When they’re feeling generous both sides will say, “We have to find out what really happened” right before they tell us what really happened, even though they don’t know what really happened.
On MSNBC, we get contributor Michelle Bernard, a black woman, telling us that what happened in Ferguson amounts to a “war on black boys” that could turn into “genocide.” We get nothing from her about the inconvenient fact that black boys are far more likely to be killed by other black boys than by white cops.
Liberals condemn abusive cops – especially when young black males are involved. Conservatives say the problem isn’t racism, but dysfunction in too many black communities.
I’ve been a reporter long enough to know that there are bad cops out there. And some are racist bad cops. I’ve also seen dysfunction in too many black neighborhoods. But both sides have a problem in polarized America acknowledging that the other side might have a point. And on TV or talk radio or on the Web, it’s simply bad business to see more than one side. People turn to partisan media to get their own biases validated. They don’t want to hear the other side. That might require them to consider some arguments they’d rather not consider.
When the police in Ferguson released the video of Michael Brown stealing some cigars and roughing up the convenient storeowner, liberals said it was a “smear.” Conservatives said – correctly, in my view – that a kid who had just committed a crime might also go after a cop he thought was on to him.
We don’t know.
None of this is a case for wishy-washy even-handedness. We all have deeply held opinions based on our values. There’s nothing wrong with that. But sometimes, especially when we don’t know the facts, it might be a good idea to keep an open mind. Maybe that cop was one of the bad ones. Who knows? Maybe the kid was a thug who after stealing the cigars instigated a confrontation with the cop that turned deadly. Could be. Hanging on to deeply held principles is one thing. Circling the wagons to protect your side, and your preconceived notions — ahead of the facts — is something else altogether.

Bill O’Reilly: Black Americans–The Truth About White Privilege
Last night on The Factor, Megyn Kelly and I debated the concept of white privilege whereby some believe that if you are Caucasian you have inherent advantages in America.
Talking Points does not, does not believe in white privilege. However, there is no question that African-Americans have a much harder time succeeding in our society. Even whites do. But the primary reason is not skin color. It’s education and not only book learning. Here are the facts.
According to the Bureau of Labor Statistics, the unemployment rate for black Americans is 11.4 percent. It’s just over five percent for whites, 4.5 percent for Asians. So, do we have Asian privilege in America? Because the truth is, that Asian American households earn far more money than anyone else. The median income for Asians, close to $69,000 a year; it’s 57,000 for whites’ $33,000 for black — so the question becomes why? And the answer is found in stable homes and in emphasis on education; 88 percent of Asian Americans graduate from high school compared to 86 for whites and just 69 percent for blacks. That means 31 percent of African- Americans have little chance to succeed in the free marketplace because they are uneducated. They are high school dropouts.
Asian Americans also tend to keep their families intact. Just 13 percent of Asian children live in single parent homes compared to a whopping 55 percent for blacks and 21 percent for whites. So, there you go. That is why Asian Americans, who often have to overcome a language barrier, are succeeding far more than African-Americans and even more than white Americans. Their families are intact and education is paramount.
American children must learn not only academics but also civil behavior, right from wrong, as well as how to speak properly and how to act respectfully in public. If African-American children do not learn those things, they will likely fail as adults. They will be poor. They will be angry, and they often will be looking to blame someone else.
One caveat, the Asian American experience historically has not been nearly as tough as the African-American experience. Slavery is unique and it has harmed black Americans to a degree that is still being felt today, but in order to succeed in our competitive society, every American has to overcome the obstacles they face. And here is where the African-American leadership in America is failing.
Instead of preaching a cultural revolution, the leadership provides excuses for failure. The race hustlers blame white privilege, an unfair society, a terrible country. So the message is, it’s not your fault if you abandon your children, if you become a substance abuser, if you are a criminal. No, it’s not your fault; it’s society’s fault.
That is the big lie that is keeping some African-Americans from reaching their full potential. Until personal responsibility and a cultural change takes place. Millions of African-Americans will struggle. And their anger, some of it justified will seethe. The federal government cannot fix this problem. Only a powerful message of responsibility can turn things around. And that’s “The Memo”.

Obama Plotting End-run Around Constitution on Global Warming Deal
President Obama reportedly plans to do an end-run around Congress to forge an international climate change deal, effectively bypassing the Constitution’s requirement to get the Senate’s approval for a treaty.
The New York Times reported that the agreement is slated to be signed at a United Nations meeting next year in Paris. However, because the U.S. Senate is unlikely to ratify any international climate treaty, Obama’s negotiators reportedly are working toward an alternative agreement – a “politically binding” deal that would serve in lieu of a bona-fide treaty.
One expert with the Natural Resources Defense Council told the Times “there’s some legal and political magic to this.”
The developments underscore the administration’s dim chances of being able to rally the constitutionally mandated two-thirds majority in the Senate to ratify a new international treaty. But at a time when the House already is suing the president over his alleged abuse of executive power, the move to go around Congress is likely to strike a nerve with lawmakers.
The Times reported that while the agreement would not have the full force of a treaty, it would “name and shame” countries into cutting fossil fuel emissions.
The proposal was described as a hybrid – combining the legally binding conditions from an existing 1992 treaty with “new voluntary pledges.”
By doing so, negotiators reportedly claim the new agreement would not require a ratification vote.
Under the terms, co-signers would have to enact climate change policies but would be on the honor system for cutting to specific emissions levels and sending money to poor countries.
IRS Lawyer: Lois Lerner’s Blackberry Deliberately Destroyed
Lois Lerner’s Blackberry was intentionally destroyed after Congress had begun its probe into IRS targeting of conservative groups, a senior IRS lawyer acknowledged in a sworn declaration.
Thomas Kane, Deputy Assistant Chief Counsel for the IRS, wrote in the declaration, part of a lawsuit filed by Judicial Watch against the IRS, that the Blackberry was “removed or wiped clean of any sensitive or proprietary information and removed as scrap for disposal in June 2012.”
That date – June 2012 – is significant because by that time, ex-IRS official Lerner had already been summoned before congressional staffers who interviewed her about reports of the IRS’ targeting of conservative groups.
“We had already talked to her. Our personal staff and Oversight Committee staff had sat down with Ms. Lerner and confronted her about information we were getting from conservative groups in the state of Ohio and around the country,” Rep. Jim Jordan, R-Ohio, told Fox News.
“If you intentionally destroy evidence, that is a crime. If you make a statement in court saying the evidence is not available and it is, that is also a crime,” said Jay Sekulow, Chief Counsel for the American Center for Law and Justice.
The IRS did not immediately respond to Fox News’ request for comment.
News of the Blackberry’s destruction followed Monday’s statement by Judicial Watch that Justice Department attorneys said in a Friday phone call the federal government backs up all computer records to ensure continuity of government in event of a catastrophe, but retrieving the Lerner emails would simply be “too onerous.”
An administration official told Fox News Monday night that Judicial Watch misinterpreted the Friday phone call. “There was no new back-up system described last week to Judicial Watch,” he said. “Government lawyers who spoke to Judicial Watch simply referred to the same email retention policy that Commissioner (John) Koskinen had described in his Congressional testimony.”
But Cleta Mitchell, an attorney who represents other conservative groups suing the IRS, cited a whistleblower who bolsters Judicial Watch’s interpretation.
“I received information from a former Department of Homeland Security official who had security clearances. He just retired in April,” Mitchell said. “He contacted me and he contacted Judicial Watch and some members of Congress and said there is backup material.”
The dueling versions are not likely to sit well with District Court Judge Emmet Sullivan, who is presiding over Judicial Watch’s lawsuit against the IRS. “He gave the IRS not one, but two opportunities in court filings with him to tell him where they were,” said Tom Fitton, president of Judicial Watch. “There was no mention of this backup system to the court at that time.”
According to Sidney Powell, author of “Licensed to Lie: Exposing Corruption in the Department of Justice,” Sullivan is known to scold government lawyers who withhold evidence.
Powell said Sullivan appointed an independent counsel to investigate DOJ’s prosecution of now deceased Republican Senator Ted Stevens of Alaska.Sullivan described the Stevens prosecution as “the worst case of misconduct he’d seen in 25 years.”
Sullivan also said, “When government does not meet its obligations to turn over evidence, the system falters.”

Actor, Director Richard Attenborough Dies at 90
LONDON – Acclaimed actor and Oscar-winning director Richard Attenborough, whose film career on both sides of the camera spanned 60 years, has died. He was 90.
The actor’s son, Michael Attenborough, told the BBC that his father died Sunday. He had been in poor health for some time. According to the BBC, Attenborough had been in a wheelchair since falling down stairs six years ago.
Prime Minister David Cameron issued a statement calling Attenborough “one of the greats of cinema.”
“His acting in ‘Brighton Rock’ was brilliant, his directing of ‘Gandhi’ was stunning,” Cameron said.
Attenborough won an Academy Award for best director with 1982’s “Gandhi,” which starred Ben Kingsley. It marked just one of many highlights of a distinguished career as actor and director.
With his abundant snow-white hair and beard, Attenborough was one of the most familiar faces on the British arts scene — universally known as “Dickie.”
He appeared in a many major Hollywood films, directed a series of movies and was known for his extensive work as a goodwill ambassador for UNICEF and other humanitarian causes.
As a director, Attenborough made several successful movies, from “Oh What a Lovely War” in 1969 to “Chaplin” and “Shadowlands” in the 1990s. But his greatest success was “Gandhi,” a film that was 20 years in the planning and won eight Oscars, including best picture.
The generation that was introduced to Attenborough as an avuncular veteran actor in the 1990s — when he played the failed theme park developer in “Jurassic Park” and Kris Kringle in a remake of “Miracle on 34th Street” — may not have appreciated his dramatic range.
A small, energetic man with a round face that remained boyish even in old age, he was perfectly cast at the start of his career as the young sailor or airman of British movies during and after World War II.
In his 1942 film debut as a terrified warship’s crewman in “In Which We Serve,” a 19-year-old Attenborough made a small part into one of the most memorable roles in the movie, which won the Best Picture Oscar.
In 1947, Attenborough gave one of the best performances of his career as the menacing teenage thug Pinkie in “Brighton Rock,” the film version of Graham Greene’s novel.
He is survived by his wife, Sheila Sim, their son and a daughter.
The family is expected to make a full statement on Monday.

An American journalist who was kidnapped entering Syria nearly two years ago has been freed.
Peter Theo Curtis was handed over to UN representatives on Sunday, just days after another U.S. reporter, James Foley, was beheaded by the Islamic State group.
Curtis was abducted in Antakya, Turkey, in October 2012 where he planned to enter Syria, according to Al Jazeera.
Footage released on June 30 shows a healthy-looking albeit disheveled Curtis.
In the video obtained by Al Jazeera, Curtis read from a prepared script stating his name and profession, saying he was a journalist from Boston, Massachusetts.
He said he had been well treated and ‘had everything’ he needed.
‘Everything has been perfect, food, clothing, even friends now,’ he said on the tape, according to the broadcaster.
‘Retaliation’: Unsealed Docs Show Prosecutors’ Broad Search Tactics Against Conservatives
Court documents released Friday in the so-called “John Doe investigation” into political supporters of Wisconsin GOP Gov. Scott Walker show prosecutors subpoenaed phone-company records and that the probe went deeper than previously known, say conservatives who were targeted.
Attorneys for conservative activist Eric O’Keefe and the Wisconsin Club for Growth point to subpoenas requested by the John Doe prosecutors that sought records from “at least eight phone companies” believed to serve the targets of the investigation, according to The Wisconsin Reporter.
O’Keefe and the club have filed a civil rights suit against the prosecutors, alleging they violated conservatives’ First Amendment rights.
“In fact, Defendants’ submissions confirm and expand upon the scope and intensity of retaliation previously demonstrated,” O’Keefe’s attorney wrote in documents ordered unsealed by the federal appeals court.
The John Doe proceeding compelled scores of witnesses to testify, and a gag order compelled them to keep their mouths shut or face jail time.
Prosecutors conducted the investigation under the theory that at least 29 conservative organizations may have illegally coordinated with Walker’s campaign during Wisconsin’s partisan political recall elections in 2011 and 2012.
The investigation was conducted by Milwaukee County District Attorney John Chisholm, a Democrat, until a federal judge halted it in May.
The newly released documents show prosecutors’ subpoena requests sought phone records for a year-and-a-half period.
Prosecutors sought “all call detail records including incoming and outgoing calls,” “billing name and information,” “subscriber name and information including any application for service,” and more, according to the conservatives’ court filing.

In an operation that was again unilateral with no Congressional approval, U.S. military support and resources were given to Islamist groups fighting against Moammar Qaddafy — and we know the results of that action. Not long after, one of the groups this administration armed, Ansar al-Sharia, took responsibility for the terrorist attack and murder of our U.S .Ambassador Chris Stevens, Sean Smith, Ty Woods, and Glenn Doherty at the Benghazi Special Mission Compound (SMC). Oh, and that same group claims it has established an Islamic caliphate in eastern Libya, based in Benghazi. Just two weeks ago, the United States of America evacuated the Libyan embassy in Tripoli due to security concerns.
But I guess it’s all hunky-dory there now, because according to the Washington Free Beacon, “The Obama administration has lifted longtime restrictions on Libyans attending flight schools in the United States and training here in nuclear science, according to a final amendment of the ban recently approved by the Office of Management and Budget (OMB).”
“Less than two years after the deadly terrorist attacks in Benghazi, Libya that killed four Americans, the Department of Homeland Security (DHS) is poised to sign off on an amendment reversing the ban, which was enacted following a wave or terrorist attacks in 1980s and prevents Libyans from studying these sensitive trades in the United States.”
We just evacuated Libya due to security concerns. There can be no doubt that Libya is an Islamic terrorist sanctuary state, thanks in no uncertain terms to Obama, and now he wants them to come here and learn how to fly planes and understand nuclear science?

The Free Beacon says “the original law effectively disqualified all Libyan nationals and those “acting on behalf of Libyan entities” from training in “aviation maintenance, flight operations, or nuclear-related fields,” according to the ban. “The Department of Homeland Security (DHS) is amending its regulations by rescinding the regulatory provisions promulgated in 1983 that terminated the nonimmigrant status and barred the granting of certain immigration benefits to Libyan nationals and foreign nationals acting on behalf of Libyan entities who are engaging in or seeking to obtain studies or training in,” the amendment states.”
DHS spokesperson S.Y. Lee who told the Free Beacon that the Obama administration is reviewing its policies towards Libya “to see how they might be updated to better align with U.S. interests” in light of its revolution.”
If I may interject here, Libya is not a stable country and there can be no alignment with U.S. interests as long as there are al-Qaida affiliated groups freely operating in that country.
Of course this action is taken when the House and Senate is away on a five-week hiatus from D.C. but at least the House Judiciary Committee responded by acknowledging, “The terror threat continues and numerous news reports document recent terror-related activities coming from Libya.”
Why wouldn’t the Obama administration allow Kurdish Peshmerga members to come to America and receive flight training so they could be given quality helicopter gunships and destroy ISIS? Can anyone explain what the strategy and objective is here in lifting this ban with a nation that is or should be on the terrorist watch list?

Missouri Cop Was ‘Severely’ Beaten Before Shooting Michael Brown
Darren Wilson, the Ferguson, Mo., police officer whose fatal shooting of Michael Brown touched off more than a week of demonstrations, suffered severe facial injuries, including an orbital (eye socket) fracture, and was nearly beaten unconscious by Brown moments before firing his gun, a source close to the department’s top brass told FoxNews.com.
“The Assistant (Police) Chief took him to the hospital, his face all swollen on one side,” said the insider. “He was beaten very severely.”
According to the well-placed source, Wilson was coming off another case in the neighborhood on Aug. 9 when he ordered Michael Brown and his friend Dorain Johnson to stop walking in the middle of the road because they were obstructing traffic. However, the confrontation quickly escalated into physical violence, the source said..
“They ignored him and the officer started to get out of the car to tell them to move,” the source said. “They shoved him right back in, that’s when Michael Brown leans in and starts beating Officer Wilson in the head and the face.
The source claims that there is “solid proof” that there was a struggle between Brown and Wilson for the policeman’s firearm, resulting in the gun going off – although it still remains unclear at this stage who pulled the trigger. Brown started to walk away according to the account, prompting Wilson to draw his gun and order him to freeze. Brown, the source said, raised his hands in the air, and turned around saying, “What, you’re going to shoot me?”
At that point, the source told FoxNews.com, the 6 foot, 4 inch, 292-pound Brown charged Wilson, prompting the officer to fire at least six shots at him, including the fatal bullet that penetrated the top of Brown’s skull, according to an independent autopsy conducted at the request of Brown’s family.
Wilson suffered a fractured eye socket in the fracas, and was left dazed by the initial confrontation, the source said. He is now “traumatized, scared for his life and his family, injured and terrified” that a grand jury, which began hearing evidence on Wednesday, will “make some kind of example out of him,” the source said.
The source also said the dashboard and body cameras, which might have recorded crucial evidence, had been ordered by Ferguson Police Chief Thomas Jackson, but had only recently arrived and had not yet been deployed.
St. Louis County police, who have taken over the investigation, did not return requests for comment about possible injuries suffered by Wilson.
Edward Magee, spokesman for St. Louis County Prosecutor Robert McCullough, said the office will not disclose the nature of the evidence it will reveal to a grand jury.
“We’ll present every piece of evidence we have, witness statements, et cetera, to the grand jury, and we do not release any evidence or talk about evidence on the case.”
Nabil Khattar, CEO of 7Star Industries – which specializes in firearms training for law enforcement and special operations personnel – confirmed that police are typically instructed to use deadly force if in imminent danger of being killed or suffering great bodily injury.
“You may engage a threat with enough force that is reasonably necessary to defend against that danger,” he said.
Wilson is a six-year veteran of the Ferguson police force department, and has no prior disciplinary infringements.
Massive protests have since taken over the St. Louis community, prompting Missouri Gov. Jay Nixon last Thursday to place Highway Patrol Capt. Ron Johnson at the helm of security operations in an effort to calm ongoing tensions. The federal government is also investigating the death, and Attorney General Eric Holder has taken the lead – calling “the selective release of sensitive information” in the case “troubling.”
On Friday, Ferguson police released surveillance video showing Brown stealing cigars from a convenience store just before his death. Jackson came under intense criticism for disclosing the tape and a related police report as he also insisted that the alleged robbery and the encounter with Wilson were unrelated matters. Brown’s family, through their attorney, suggested the tape’s release was a strategic form of “character assassination.”
However, FoxNews.com’s source insisted that there was absolutely no spin agenda behind the tape’s release and that there were a number of Freedom of Information Act (FOIA) media requests filed by media outlets seeking it. Tom Jackson is said to have waited on publicly releasing it, and did not want it shown until Brown’s grieving mother first had the chance to see it.
“He defied the FOIAs as long as he could,” noted the insider. “A powerful, ugly spin has completely ruined public discourse on this whole situation.”

ISIS Beheads American Journalist, Threatens Another
U.S. intelligence officials were analyzing Wednesday a video released by Islamic militants showing the beheading of American journalist James Foley, focusing on identifying the surrounding landscape and the British accent of his executioner.
The identification of his killer is said to be of top importance to U.S. and European intelligence officials.
The video — originally posted by ISIS to YouTube, which later took the video down — also shows an ISIS militant standing over a second man dressed similarly to Foley in an orange jumpsuit. The video identifies the second man as American journalist Steven Sotloff, and warns that he, too, could be killed. Sotloff was kidnapped near the Syrian-Turkish border in August 2013, and freelanced for Time, the National Interest and MediaLine.
While the Obama administration has not yet officially authenticated the video or confirmed Foley’s death, U.S. officials who asked not to be identified told Fox News that the man beheaded in the video is Foley.
A statement by Foley’s mother, Diane, posted on the “Find James Foley” Facebook page requested privacy “as we mourn and cherish Jim.” A priest arrived at her Rochester, N.H. home on Tuesday.
“We have never been prouder of our son Jim. He gave his life trying to expose the world to the suffering of the Syrian people,” the message said. “We implore the kidnappers to spare the lives of the remaining hostages. Like Jim, they are innocents. They have no control over American government policy in Iraq, Syria or anywhere in the world.”
The orange jumpsuits worn by both captives in the video are synonymous in Jihadi propaganda with Guantanamo Bay and the first wave of prisoners who were held there at Camp X-Ray.
Fox News has learned that the video, which is being taken seriously by U.S. officials, is being analyzed by a group within the U.S. intelligence community that specializes in media exploitation. The Islamic State militant group, formerly known as the Islamic State of Iraq and Syria, is believed to have other Americans in their custody.
An intelligence source told Fox News that the landscape of the video is being analyzed to determine a likely location. Investigators also are planning to analyze the voices in the tape, including the masked executioner who appears to speak with a British accent, and whether or not the individual is linked to Britons known to have traveled to Syria.
British officials have said that several hundred people from Britain have traveled to Syria to join the battle against President Bashar Assad, and some may have crossed into Iraq as part of the rapid advance of the Islamic State group. French and German officials have recently put the combined total of those countries around 1,300.
Shiraz Maher of the International Center for the Study of Radicalization at King’s College London, said the video was evidence that British jihadis were “some of the most vicious and vociferous fighters” in Syria and Iraq.
The masked militant in the clip speaks fluent English with what Lancaster University linguist Claire Hardaker said sounds like a London accent.
“Unfortunately the British participation in the conflicts now raging in both Syria and Iraq has been has been one of full participation, one that has seen them at the front lines, taking part in the conflict in every way,” Maher told BBC radio. “So we have seen British fighters out there operating as suicide bombers, we have seen them operating as executioners.”
A law enforcement source told Fox News that the FBI has no reason to doubt the authenticity of the tape, but further analysis is ongoing before an “official conclusion” is made. The FBI is working closely with its British counterpart, the source added.
White House National Security Council spokeswoman Caitlin Hayden said the administration has seen the video. She said that if it’s deemed genuine by the intelligence community, the U.S. would be “appalled by the brutal murder of an innocent American journalist.”
President Obama was briefed on the video Tuesday night by Deputy National Security Adviser Ben Rhodes on Air Force One, Deputy Press Secretary Eric Schultz said.
Adam Schiff, D-Calif., who sits on House Intelligence Committee, called the video “appalling.”
“The apparent beheading of photojournalist James Wright Foley adds to the appalling parade of horrors perpetrated by [ISIS]. Seldom is the descriptor ‘evil’ applied with perfect accuracy as it is with this monstrous group that glories in death,” he said in a statement. “They know no human decency — murdering journalists, beheading religious minorities refusing to convert, victimizing women and children, and starving entire communities.”
The video also prompted British Prime Minister David Cameron to return to London early from his vacation.
“He will meet with the foreign secretary and senior officials from the Home Office, Foreign Office and the agencies to discuss the situation in Iraq and Syria and the threat posed by [ISIS] terrorists,” read a statement from the prime minister’s office.
The release of the video comes amid a U.S. airstrike campaign against Islamic State targets in Iraq. ISIS has declared an Islamic state in the territory it controls in Iraq and neighboring Syria, imposing its harsh interpretation of Islamic law.
Foley, 40, a freelance journalist, vanished in Syria in November 2012 while covering the Syrian civil war for GlobalPost. The car he was riding in was stopped by four militants in a contested battle zone that both Sunni rebel fighters and government forces were trying to control. He had not been heard from since.
The publication “mounted an extensive international investigation” for his whereabouts, with the search extending throughout the Middle East, along the Syria-Turkish border, in Lebanon, Jordan and other locations, GlobalPost reported Tuesday.
In 2011, Foley was among a small group of journalists held captive for six weeks by the government in Libya and was released after receiving a one-year suspended sentence on charges of illegally entering the country. In a May 2011 interview about his experience, he recounted watching a fellow journalist being killed in a firefight and said he would regret that day for the rest of his life. At the time, Foley said he would “would love to go back” to Libya to report on the conflict and spoke of his enduring commitment to the profession of journalism.
“Journalism is journalism,” Foley said during the AP interview, which was held in GlobalPost’s office in Boston. “If I had a choice to do Nashua (New Hampshire) zoning meetings or give up journalism, I’ll do it. I love writing and reporting.”
The New York-based Committee to Protect Journalists (CPJ) condemned what it called a “barbaric murder. The organization estimated Tuesday that about 20 journalists are missing in Syria, and has not released their nationalities.
In its annual report last November, CPJ concluded that the missing journalists are either being held and threatened with death by extremists, or taken captive by gangs seeking ransom. The group’s report described the widespread seizure of journalists as unprecedented and largely unreported by news organizations in the hope that keeping the kidnappings out of public view may help in the captives’ release.
Marquette University, Foley’s alma mater, said it was “deeply saddened” by the news of Foley’s death. The Milwaukee university said he had a heart for social justice and used his talents to tell stories in the hopes they might make a difference.
“We extend our heartfelt prayers and wishes for healing to James’ family and friends during this very difficult time,” Marquette University said in a statement.
Earlier Tuesday, GlobalPost CEO and co-founder Philip Balboni in a statement asked “for your prayers for Jim and his family.” AFP chairman Emmanuel Hoog said the French news agency was “horrified” by the video and called Foley “a brave, independent and impartial journalist.”

Liberals Threaten Massive Western Land Grab
Utah officials are scrambling to prevent the Obama administration from locking down thousands of acres of land in their backyard, as federal officials consider up to a dozen possible national monument designations – all in western states.
The Antiquities Act gives U.S. presidents the authority to unilaterally declare public lands as national monuments at the stroke of a pen, with no input from the public unless they choose to seek it.
Many national monuments eventually go on to become national parks.
National Parks Conservation Association spokeswoman Kristen Brengel said the practice has been used for over a century to preserve some of America’s most iconic landmarks: including the Grand Canyon, the Statue of Liberty and Arches National Park.
“It’s a wonderful tool to conserve these resources so that people can enjoy them in perpetuity,” she said.
But critics feel the Antiquities Act has been misused in recent decades by presidents of both parties and, in Utah, they’re seeking a compromise that would allow some land to become designated as “wilderness” instead.
“The original Antiquities Act passed as a way of conserving land,” Republican Utah Rep. Rob Bishop said. “It’s no longer used that way. Now it’s used as a political purpose to make a political statement on land that is not endangered in any way.”
The issue is particularly sensitive in the American West, where the vast majority of federally owned and controlled land lies.
“In the West, almost half of the land, versus 4 percent in the East, is owned by the federal government,” Bishop said. “So in my state of Utah, 70 percent is owned and controlled by the federal government. So we in the West clearly see this differently, because we face it and live with it every day.”
A draft Interior Department memo in 2010 suggested 12 sites for possible national monument designation by President Obama. The land already is mostly in federal hands, but a monument designation would more tightly restrict access.
All of the sites are in the West, including Organ Mountains-Desert Peaks in New Mexico, which President Obama declared a new national monument in May.
Four of the other 11 sites in the Interior memo are in the state of Utah. Recently, 14 U.S. senators wrote to Obama urging him to declare a Greater Canyonlands monument in Utah. None of the senators live in the Intermountain West, much less the state of Utah, where anger over a previous national monument designation is still palpable.
Utah Gov. Gary Herbert recalled how then-President Clinton designated the Grand Staircase-Escalante National Monument in southern Utah, by far the nation’s largest, covering an area the size of Delaware and Rhode Island combined.
“President Clinton in 1996 — denying that he was going to do it without any input from our congressional delegation or local government or state government — just one day announced this designation,” Herbert said.
Bishop said “there were so many problems with it that were never solved when it was created.”
“They were never solved because it was a simplistic overreach and you didn’t go into the details,” he said.
Emery County Commissioner Ethan Migliori said the monument is still a “bitter conversation in Utah.”
The problem, Migliori said, is the designation effectively “shut down everything” in that area.
“You can’t access it anymore … even on designated roads,” Migliori said.
Brengel said this president won’t declare national monuments without warning. “One of the main things that the Obama administration has said is that they are looking for local input. Not just from local leaders but also from the public,” Brengel said.
Not willing to wait and see, Bishop has proposed a public lands initiative to work out a compromise. Instead of becoming national monuments, some land would become protected wilderness areas while allowing development on the rest.
Migliori and other officials in Emery County, where 92 percent of the land is owned by the federal government, support Bishop’s efforts wholeheartedly. The proposed San Rafael National Monument would take up nearly 1,000 square miles, almost all of it in Emery County.
“It appears you have more access to a national park than you do to a national monument,” Migliori said. “So a national monument is almost a death wish, or it feels like that to us.”
Several environmental groups are also taking part in the discussions. “We are willing to work with any member of Congress on these proposals. We understand that their constituents have various interests. Ours in particular would be to protect some areas as wilderness or national parks,” Brengel said.
Herbert is also on board, saying: “The environmental community, industry, local civic and business leaders, farmers, ranchers, energy developers … All of the above come together and talk about what areas need to be developed and how, and what areas need to be preserved and protected because of their iconic vistas and venues.”
Bishop said Interior Secretary Sally Jewell has spoken to him twice about his public lands initiative. “The secretary of Interior is encouraging us to move forward in doing it this way because it’s a much more satisfactory process than ever it would be if you used the Antiquities Act,” he said.
Even Democrats Critical of Obama’s Failure to Stop ISIS
Congressional Democrats were critical Sunday of President Obama’s efforts to stop Islamic militants in the Middle East, suggesting the “mission has been lost” and that U.S. troops might be needed in Iraq.
The criticism follows Islamic State’s unexpected rise in Syria and deadly run across Iraq, which has been met by a U.S. humanitarian effort that includes air strikes on the militant group’s military operations.
Rep. Eliot Engel, D-N.Y., told “Fox News Sunday” that the United States might need ground troops to fight Islamic State, the militant group also known as ISIS, in Iraq and Syria.
“Ultimately, we may have some boots on the ground there,” said Engel, the top Democrat on the House Foreign Affairs Committee. “That’s not something I want,” but we cannot “put our head in the sand.”
Engel has been one of the most outspoken Democrats on President Obama’s foreign policy. And his remarks Sunday appear contrary to those made by fellow party members and Americans, according to recent public-opinion polls.
However, fellow congressional Democrat Tulsi Gabbard said Sunday that the Obama administration’s overall mission to thwart Islamic State and other Islamic extremists in the Middle East “has been lost.”
The Hawaii lawmaker told ABC’s “This Week” that she is particularly critical of the administration saying the U.S. airstrikes on Islamic State in Iraq are part of larger humanitarian effort.
“We’re missing a critical question here,” said Gabbard, a member of the House Foreign Affairs Committee, who said she joined the Army National Guard after the 9/11 terror attacks because U.S. leaders vowed to “take out Islamic extremists wherever they are.”
“That mission has been lost. [The administration] said the air strikes are not a campaign against ISIS. If our mission is not about taking out extremists, then we’ve got a real problem here,” she said.
Engel argued the U.S. should have armed the Free Syrian Army to help stamp out Islamic State when the group was emerging in the early stages of Syrian’s civil war.
Their remarks come as Congress is on August break and 10 days after Obama announced the airstrikes-humanitarian effort in Iraq.
Whether the House or Senate votes to reauthorize the use of force in Iraq remains to be seen, considering the political implications of saying yes or no seven weeks before the midterm elections.
Sen. Ron Johnson, R-Wis., told Fox News that Obama had already met with eight or nine members of the Armed Services and Foreign Relations committees to discuss a new authorization.
He called the effort a “good sign” and said Congress is “really tired of presidents just going in by themselves.”
Sen. Bernie Sanders, I-Vt., chairman of the Senate Veterans Affairs Committee, told The Hill newspaper last week that Congress should have a full debate on whether to continue limited military action in Iraq.
On Sunday, Michigan GOP Rep. Mike Rogers, chairman of the House Permanent Select Committee on Intelligence, said the U.S. needs a “comprehensive plan to deal with Islamic State both in Syria, their safe haven, and Iraq.”
He also said Obama “does not play well with others” regarding such policy issues and that he doesn’t think the president legally needs a vote for reauthorization.
“But I think he should work with Congress,” Rogers said. “And he should step up that part of his game right now, given the world threats that we face today.”

Press Becoming Tired of Obama Administration ‘Spin’ Machine
While Congress is on recess and President Obama vacations in Martha’s Vineyard, a coalition of free press groups is escalating an already-aggressive campaign against the Obama administration for allegedly freezing out the press and cracking down on reporters.
The flood of critical letters and petitions and statements from First Amendment groups marks a new level of tension in a relationship that for years has been deteriorating. Though Obama, as a candidate in 2008, was widely seen to enjoy favorable media treatment, his administration now is fielding accusations that it’s one of the least transparent in history.
Society of Professional Journalists President David Cuillier, in a statement earlier this week, blasted the administration for what he called “excessive message management and preventing journalists from getting information on behalf of citizens.”
SPJ is among the groups that’s been leading the charge on the issue. Last month, more than three dozen groups, including SPJ, wrote to the White House about what they described as growing censorship throughout federal agencies.
Cuillier’s latest statement came in response to White House Press Secretary Josh Earnest’s Aug. 11 letter to his organization regarding their complaints.
In it, Earnest said Obama’s commitment to transparency is “unwavering.” While he acknowledged “there will always be a healthy, natural tension between journalists and the White House,” Earnest vowed greater transparency going forward and pointed to several steps the administration has taken: like processing more “freedom of information” requests, declassifying records and releasing information on White House visitors.
“Typical spin and response through non-response,” Cuillier shot back.
He said he hopes the administration is “sincere” about being more open, “but we want action. We are tired of words and evasion.”
Media groups are gearing up for another confrontation on Thursday, when they plan to present a petition with 100,000 signatures — backed by the Committee to Protect Journalists, the Freedom of the Press Foundation and others — to the Justice Department. It calls for the administration to halt legal action against New York Times reporter James Risen, who detailed a botched CIA effort during the Clinton administration to thwart Iran’s nuclear ambitions.
Risen’s reporting is at the center of criminal charges against former CIA officer Jeffrey Sterling. Federal prosecutors want to force Risen to testify about his sources at Sterling’s trial, and the Supreme Court recently refused to get involved in the case.
Risen argued he has a right to protect his sources’ identity, either under the Constitution or rules governing criminal trials. A federal appeals court in Richmond, Va., earlier rejected Risen’s bid to avoid being forced to testify.
At the same time federal prosecutors have fought Risen in court, Attorney General Eric Holder has suggested that the government would not seek to put Risen in jail should he refuse to testify as ordered.
But journalist groups want assurances. Risen also is expected to speak during a press conference at the National Press Club on Thursday afternoon.
The case follows tension last year surrounding the Justice Department’s snooping on Fox News’ reporter James Rosen’s phone records and emails, and its seizure of AP phone records in the course of leak investigations. The controversy over those actions led to some reforms at the Justice Department.
Press groups’ complaints about the administration are manifold. They say agencies are prohibiting staffers from talking to journalists without public affairs office approval — and sometimes without public affairs employees sitting in on interviews. Further, they complain about long delays in getting information and about communications staff speaking “confidentially” even on routine matters.
In yet another complaint, journalist and scientific organizations accused the Environmental Protection Agency on Tuesday of attempting to muzzle its independent scientific advisers by directing them to funnel all outside requests for information through agency officials.
In a letter, the groups representing journalists and scientists urged the EPA to allow advisory board members to talk directly to news reporters, Congress and other outside groups without first asking for permission from EPA officials. An April memo from the EPA’s chief of staff said that “unsolicited contacts” need to be “appropriately managed” and that committee members should refrain from directly responding to requests about committees’ efforts to advise the agency.
The scientific advisory board’s office had asked the EPA to clarify the communications policy for board members, who are government employees.
“The new policy only reinforces any perception that the agency prioritizes message control over the ability of scientists who advise the agency to share their expertise with the public,” the groups wrote.
The chair of that panel, H. Christopher Frey, said in an interview with the Associated Press Tuesday in which he stressed he was offering his personal opinion, that he found the tone of the EPA memo to be unnecessary.
Frey, a distinguished professor in North Carolina State University’s engineering department, said that many of the scientists that seek to serve on the committees are national and internationally-renowned experts and that EPA “need not be too strong in precluding interactions with the media or others.”
An EPA spokeswoman said there are no constraints on members fielding requests in a personal or professional capacity. She said the memo was designed to assure transparency.
