Federal investigators examined the Minnesota Democrat’s controversial marriage as early as 2016. The inquiry was closed due to statute of limitations, but newly disclosed details complicate claims that the investigation originated with President Trump.

WASHINGTON — A significant new development in the federal investigation of Representative Ilhan Omar has emerged: The FBI and Department of Homeland Security investigated allegations of marriage fraud involving the Minnesota Democrat in 2016, during the final year of Barack Obama’s presidency, long before Donald Trump entered to the White House.
According to reporting published Thursday by Fox News, citing an investigation first disclosed by The New York Times, federal authorities examined allegations that Omar’s 2009 marriage to Ahmed Nur Said Elmi was fraudulent. Investigators reportedly uncovered some evidence suggesting the marriage may have been arranged for immigration purposes, but prosecutors declined to pursue charges because the suspected felony conduct was considered too old to prosecute under the applicable statute of limitations.
The revelation changes an important part of the public narrative surrounding the current investigation. Although the Trump administration has revived scrutiny of Omar’s immigration history, the underlying allegations had previously attracted the attention of federal law-enforcement agencies operating during a Democratic presidency.
The Investigation Began During Obama’s Presidency
The earlier inquiry reportedly began during the summer of 2016, when Omar was campaigning for a seat in the Minnesota House of Representatives. Federal investigators examined allegations involving her marriage to Elmi, including claims that the relationship was not a genuine marital union.
According to the latest reporting, investigators found information suggesting possible fraud, but the evidence and investigative findings have not been publicly released in sufficient detail to establish precisely what authorities concluded. The reported expiration of the criminal statute of limitations also meant that prosecutors faced legal restrictions on pursuing charges for conduct dating back to 2009.
A subsequent inquiry was terminated in 2021 under a U.S. attorney appointed by President Joe Biden. The account of why the earlier investigations ended remains disputed: Omar’s representatives maintain that the allegations were rejected for insufficient evidence, while the new reporting identifies the statute of limitations as a decisive factor in the 2016 inquiry.
An investigation closed because prosecutors lack sufficient evidence is materially different from one closed because a potential offense can no longer be prosecuted. Obtaining the original investigative records would help resolve the discrepancy.
Obama’s Recent Defense of Omar Takes on New Significance
The disclosure follows former President Obama’s public condemnation of the October 12 federal search of Omar’s Washington residence.
In an October 18 statement, Obama accused the Trump administration of using federal law enforcement against a political opponent. He argued that government authorities should not selectively target citizens because of their political beliefs and characterized the investigation as an example of such conduct.
The newly reported 2016 inquiry adds important context to that criticism. Federal investigators were examining allegations concerning Omar while Obama himself occupied the White House.
The Current Investigation Is More Extensive
The renewed federal inquiry has already resulted in a court-authorized search of Omar’s Washington residence, the seizure of electronic devices and other records, and grand jury subpoenas involving members of her family.
Investigators are examining whether Omar or relatives provided false information in immigration and naturalization documents dating to the family’s arrival in the United States from Somalia in 1995. Reports indicate that questions concerning her birth date, family relationships, and citizenship documentation are among the matters under review.
The current investigation also extends beyond the 2009 marriage allegations. Authorities are examining whether statements made during the family’s earlier immigration process were accurate, raising potential legal questions distinct from those considered in the original inquiry.
No criminal charges against Omar have been announced yet, but prosecutors told a federal court this week that investigators are continuing to review evidence seized during the October 12 search.
The Battle Over the Search Warrant
Another development emerged Wednesday when the Justice Department opposed requests by news organizations and Judicial Watch to release the search warrant and supporting affidavit.
Federal prosecutors argued that disclosing the materials while investigators are still examining evidence could compromise the inquiry. The matter is before Chief Judge James Boasberg of the U.S. District Court for the District of Columbia.
The sealed affidavit is particularly important because it may eventually reveal what evidence persuaded a federal magistrate judge to authorize the search, which allegations investigators are pursuing, and how the current investigation relates to earlier inquiries.
Until those records become available, the public cannot independently assess the full evidentiary basis for the government’s actions.
A Decade of Questions, and an Opportunity for Answers
The newly reported Obama-era investigation establishes that allegations concerning Omar’s marriage and immigration history were examined by federal authorities years before the current administration took office.
It also introduces a potentially important distinction between an investigation that produced no prosecutable evidence and one that could not proceed because of legal time limits.
Those questions should be resolved through the release of authenticated investigative records, not competing political assertions. The reported findings from 2016, the circumstances surrounding the closure of subsequent inquiries, and the evidence supporting the current search warrant are all relevant to understanding how the government has handled the allegations over the past decade.
The public is entitled to know whether investigators uncovered credible evidence of fraud, whether prosecutors applied the law consistently, and whether the present inquiry is being conducted independently and lawfully.
The central revelation is that federal scrutiny of Ilhan Omar’s controversial marriage did not begin with Donald Trump. It reportedly began under Barack Obama. What remains to be established is precisely what those investigators discovered—and why the matter was never brought before a court.
